What’s Legal and What’s Not: Flying with CBD Oil and Tinctures

Last spring, TSA updated their policies regarding CBD. Prior to this, all CBD was grouped together with illegal marijuana or cannabis products and treated as illegal according to federal law. Well, federal law changed when the 2018 Farm Bill was passed, making some CBD products legal in the U.S. TSA has adjusted their policies to reflect federal law. So, can you take CBD oil on a plane? Here’s how it shakes out.

CBD Products are Legal for U.S. Air Travel If They:

  • Are hemp-derived
  • Contain less than 0.3% THC

CBD Products are NOT Legal for U.S. Travel If They:

  • Are infused with marijuana or cannabis
  • Contain greater than .3% THC

Remember that THC is the psychoactive component of hemp and marijuana that causes a “high,” and it’s found in much higher levels in the Marijuana plant. For more about the difference between hemp and marijuana, check out our article What Does CBD Stand for and What Is It Anyway?

CBD with less than .3% THC has virtually no “high” effect, making CBD products much different than marijuana.

If your CBD meets these guidelines, it’s legal to bring on U.S. flights.

Before throwing your CBD oil or other products into a suitcase or carry-on bag, check out these tips to make sure your CBD is protected!

Know Your Labels

Check out your labels and look for language like “hemp-derived” and “less than .3% THC”. Be sure to pack CBD products with these criteria only. If you have other types of products, leave them at home, even if you live in a state where marijuana or medical marijuana is legal. Be able to point to these important label features if a TSA agent questions you about the items.  If you have prescription CBD, bring the prescription with you for backup.

Don’t Try to Hide It

Remember, your CBD products are legal, but if you act sketchy and try to hide them in an obscure part of your luggage, you will seem suspicious. At the very least, you’ll cause yourself additional hassle and time. Instead, pack CBD products in your carry-on (most ideal) or in your checked luggage along with your other toiletry items. If you’re not trying to hide your hemp products, you can bring your CBD oil on a plane without incident.

Follow TSA Carry-On Guidelines

According to TSA policy, you’re allowed to travel with one quart-sized clear bag of liquids (including aerosols, creams, pastes, and gels) in your carry-on bag. Each of these containers must be 3.4 oz or less. Include your CBD oils, tinctures, salves, or rubs in this bag, especially if you plan to use them during your travels. Other CBD items can be packed in your checked bag, in a logical place like with your toiletries. Breakable bottles travel best in your carry-on.

International Flights

Your CBD is safe when you follow these guidelines for U.S. departures, but check the CBD laws in your destination country before packing up.

What Does CBD Stand for and What Is It Anyway?

What Does CBD Stand for?

CBD is short for cannabidiol, which is an active ingredient found in both the marijuana plant and the hemp plant (two distinct plants within the cannabis family). CBD is largely legal to sell and purchase in the United States when it’s derived from the hemp plant (not the marijuana plant). Why?  Hemp plants naturally have much lower levels of THC, the ingredient that gives you a high when ingested.

Hemp-derived CBD sold in the U.S. cannot contain more than 0.3% THC. This allows you to get the therapeutic benefits without the mind-altering drug effect.  

According to the World Health Organization, there’s no potential for pure hemp-derived CBD to be abused or cause addiction, and there’s no evidence it causes any health problems.

When consumed alone – CBD doesn’t get you “high” or have any psychoactive effect. So you don’t have to worry about it having the same impact as traditional marijuana.

People grow, sell, and consume CBD to help with ailments and various types of pain. Many consumers say they experience notable relief from aches and pains, the effects of chemotherapy, anxiety, insomnia, and much more.

Hemp has been cultivated for thousands of years. The hemp plant originated in Central Asia and became popular throughout Europe during the Middle Ages. Today, China and Canada are the largest exporters of the industrial hemp crop.

Is CBD Legal?

After asking, “What does CBD stand for?” the next logical question becomes – “Is it legal to purchase?” It’s an important question but can be boiled down to a few simple facts.

Until recently, growing hemp was illegal in the United States because of its relationship to the marijuana plant. Thanks to the 2018 Farm Bill, U.S. farmers can now grow hemp for the purpose of producing hemp-derived CBD. The bill removed hemp from the Controlled Substance Act and reclassified it for commercial use. So, it’s no longer lumped together with its ugly cousin – marijuana .

Best of all, federal law now makes it legal to sell CBD products in most states. However, state laws in Idaho, Nebraska, and South Dakota have declared all products from the marijuana or hemp plant illegal. So you can’t legally produce or purchase hemp-derived CBD in those states.

How Does It Work?

Your body produces its own cannabinoids (CBD or cannabidiol is a type of cannabinoid), and scientists call this bodily system the Endocannabinoid System or EC System. It regulates things like sleep, mood, appetite, memory, fertility, inflammation, and pain.

Your EC system uses two receptors CB1 (affects sleep, mood, appetite, memory, etc.) and CB2 (affects inflammation and pain) to receive messages and create effects in the body.

When a person consumes marijuana or detectable levels of THC, the THC directly attaches to the CB receptors and basically hijacks the messaging, affecting your sleep appetite, memory, etc. This is what makes you feel “high”.

When a person consumes hemp-derived CBD only, the CBD doesn’t attach to the CB receptors like THC does. Instead, researches now understand that CBD doesn’t directly interact with the receptors in your brain at all but instead stimulates your body to use more of its own cannabinoids.

Therefore, CBD doesn’t make you feel high, and according to many people, you still feel therapeutic affects after consuming CBD products.

Is CBD for Anxiety Effective? Recent Studies Say ‘YES!’

Current research suggests CBD for anxiety is an effective, safe, and well-tolerated means for reducing anxiety symptoms, even in those patients with PTSD. Nearly 40 million adults in the U.S. suffer from some form of anxiety and there’s no indication these numbers will fall any time soon.

So, if you’ve been diagnosed with an anxiety condition, you’re certainly not alone!

Big pharma has produced an extensive number of medications to treat anxiety, and many patients are thankful for the help. However, the routine side-effects, increasing dosages, and combined prescriptions have probably driven you to seek more effective, long-term, and natural treatments.

What Research Says About CBD for Anxiety

A study was published in January 2019 by the National Center for Biotechnology Information (NCBI) and found:

  • Anxiety levels dropped in about 79% of patients after using CBD for a month
  • Anxiety remained at lower levels throughout the study
  • Few notable side-effects reported
  • CBD better tolerated than anti-anxiety medications
  • CBD treatment produced “clinically significant” anxiety relief
  • Patients experienced no altered consciousness or “high”

Fewer side effects means a huge win for CBD, because traditional anti-anxiety medications come with a truckload of them. But adding CBD to your anxiety treatment plan doesn’t mean you can or should stop other medications.

In this study, patients continued taking psychiatric medications and some were also receiving mental health services.  However, significant improvement in anxiety levels began after introducing CBD as part of the treatment. Additionally, all patients in the study were diagnosed by a psychiatrist, which typically suggests more severe symptoms. This makes symptom-relief even more promising if you suffer from mild to moderate anxiety.

What Research Says About CBD for PTSD            

In April 2019, an 8-week study on CBD and the treatment of PTSD reports reduced symptoms in 91% of participants. Moreover, those patients with frequent PTSD-related nightmares reported having fewer nightmares while taking CBD.

As in the previous study, these patients continued psychiatric care and prescription medications while participating, but significant improvement occurred after adding CBD to the treatment plan.

Here are a few other highlights from the CBD and PTSD study:

  • Doses used were lower than in other research
  • Patients reported greater symptom improvement with higher doses
  • Patients received liquid spray and capsule forms of CBD
  • Study shows a sustained decrease in symptoms

Nearly 8 million adults in the U.S. suffer from PTSD and the condition can last months or even years. It’s a severe type of anxiety that typically develops after a traumatic event, like rape, abuse, war, mass violence (terrorist attack), or a natural disaster.

Interestingly, experts say that women are far more susceptible to PTSD than men, and about 1 in 10 women will develop this condition at some point in her lifetime.

While research results on using CBD for anxiety are very promising, more controlled, clinical trials are needed for conclusive results.

How to Take CBD for Anxiety

As always – talk to your doctor before using CBD products and be sure you know what you’re getting before you buy. In general, higher doses of CBD have more success in reducing anxiety, symptoms – but everyone is different.
